Terms of Use
Last updated: [DATE] — draft pending legal review
These Terms of Use ("Terms") govern your access to and use of feedstays.com, its store pages (feedstays.com/s/{handle}), embedded widgets, hotel pages, and the AI chat assistant (the "Desk") (together, the "Service"). By using the Service, you agree to these Terms.
1. Who operates FeedStays
FeedStays is operated by Nex Local Services Inc, a [STATE OF INCORPORATION] corporation ("FeedStays," "we," "us"). Support: support@feedstays.com.
2. What FeedStays is — and isn't
FeedStays lets you discover and book hotel rooms through creator-curated stores, widgets, hotel pages, and the Desk. Hotels on FeedStays are supplied either through our booking partner Nuitée (LiteAPI), which is then the merchant of record, or under a direct contract between the hotel and FeedStays (PT Nex Entertainment Technology), in which case FeedStays is the seller and payment is processed by Xendit. Your checkout page and confirmation email state which applies to your booking. For Nuitée bookings you pay through Nuitée's hosted card form. For direct-contract bookings you pay by QRIS through Xendit. FeedStays never receives or stores your card details.
FeedStays sets the displayed price at or below the price shown on major online travel agencies where that price is known to us. A creator whose store you book through may lower the price further by giving up part of their own commission — a creator's commission never increases the price you pay.
3. The Desk (AI assistant)
The Desk is an AI chat assistant (powered by Anthropic's Claude) available on creator store pages to answer questions about that creator's featured hotels. The Desk does not complete bookings; it can only hand you a checkout link. Desk conversations are retained for 90 days for quality and support purposes. You can request deletion of your Desk conversation history by emailing support@feedstays.com.
4. Booking, prices, and hotel policies
- Prices shown at checkout include taxes. Some hotels charge additional resort or local fees directly at the property; these are set by the hotel, not FeedStays [COUNSEL: confirm disclosure wording].
- Each booking is subject to the hotel's own cancellation policy (refundable or non-refundable), with the applicable free-cancellation deadline shown at checkout before you pay.
- For Nuitée bookings, Nuitée is the merchant of record and your contract for the stay is with Nuitée and the hotel, not with FeedStays. FeedStays operates the discovery, curation, and checkout experience and is not a party to that travel contract. For direct-contract bookings, FeedStays (PT Nex Entertainment Technology) is the seller of the stay. [COUNSEL: confirm the contracting-party wording for direct bookings.]
5. Managing and cancelling a booking
After booking, you'll receive a private "manage booking" link by email. If your rate is refundable and you are before the free-cancellation deadline, you can cancel online using that link. Otherwise, contact support@feedstays.com. For direct-contract stays, FeedStays sends the refund within 1 working day to the original payment method where the payment app supports it, otherwise by bank transfer. For Nuitée bookings, refund timing is determined by Nuitée and your card issuer.
6. Referral program
After completing a booking, you may receive an invite link to share.
- A friend who books through your invite link gets $15 off their booking, if the hotel's supplier minimum price allows a discount at that time (otherwise no discount applies).
- You receive $15 in FeedStays credit once your friend's stay is completed.
- Credit has no cash value, is not transferable, requires a minimum booking of $150, can cover at most 50% of a single booking, and expires 365 days after it's granted.
- Each referral code is limited to 50 total uses and 3 uses per day.
- Credit can only be applied while you are signed in via an emailed sign-in link.
FeedStays may adjust referral terms, amounts, or eligibility at any time; changes apply to credit granted going forward, not retroactively.
7. Accounts and sign-in
Guests spending credit, and creators managing a store, sign in via Firebase Authentication (Google sign-in or an emailed sign-in link). You're responsible for keeping access to your email account secure.
8. Creators and stores
Hotels booked through a creator's store, widget, or Desk pay that creator a commission, described in the separate Creator Program Agreement. Creator content (bios, notes, video embeds) displayed on a store page is provided by that creator; FeedStays is not responsible for creator content.
9. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to circumvent pricing, referral, or credit limits through fraud, automation, or multiple accounts; interfere with the Service's operation; or scrape or misuse the Service's data.
10. Disclaimers
The Service is provided "as is." FeedStays does not guarantee hotel availability, pricing accuracy at the source OTA, or that the Desk's answers are complete or error-free. Your stay is governed by the hotel's own policies and by the terms of the merchant of record for your booking (Nuitée, or FeedStays for direct-contract stays).
11. Limitation of liability
To the maximum extent permitted by law, FeedStays's liability arising out of or relating to the Service is limited to the amount of fees (if any) you paid to FeedStays directly in the twelve months before the claim arose. FeedStays is not liable for indirect, incidental, or consequential damages. [COUNSEL: confirm limitation-of-liability language and any state-specific carve-outs.]
12. Governing law and disputes
[COUNSEL: confirm governing law and arbitration/venue clause.]
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date.
