Creator Program Agreement
Last updated: [DATE] — draft pending legal review
This Creator Program Agreement ("Agreement") governs your participation as a creator running a FeedStays store (feedstays.com/s/{your-handle}), embedded widget, or Desk-linked storefront. By claiming a store, you agree to this Agreement in addition to the Terms of Use.
FeedStays is operated by Nex Local Services Inc, a [STATE OF INCORPORATION] corporation. Support: support@feedstays.com.
1. Your relationship with FeedStays
You are an independent contractor, not an employee, agent, partner, or joint venturer of FeedStays. You are responsible for your own taxes, and for complying with laws applicable to your promotional activity. FeedStays will issue a Form 1099-NEC where required by law (see Section 6).
2. What your store does
Your store, widget, or Desk-linked page lets your audience browse and book hotel rooms. Hotel rooms are supplied either through our booking partner Nuitée (LiteAPI), which is then the merchant of record, or under a direct contract between the hotel and FeedStays (PT Nex Entertainment Technology), in which case FeedStays is the seller and payment is processed by Xendit. The checkout page and confirmation email state which applies to each booking. You do not handle guest payment information at any point.
3. Handles
Store handles are assigned first-come, first-served, except for reserved words. FeedStays may reclaim a handle that impersonates another person or brand, or infringes someone else's trademark or rights.
4. Your commission
You earn a commission on the selling price of stays booked through your store, widget, or the Desk when it recommends your featured hotels:
| Level | Trailing-12-month completed-stay volume | Commission rate |
|---|---|---|
| 0 | — | 5% |
| 1 | ≥ $25,000 | 6% |
| 2 | ≥ $100,000 | 7% |
- Levels are recalculated quarterly, on January 1, April 1, July 1, and October 1, based on your trailing 12 months of completed-stay volume. Your level — and therefore your rate — can go down as well as up.
- Volume is measured on the price before any referral discount or credit is applied.
- If you lower your price for your audience, the discount comes out of your own commission — it never increases the guest's price and never reduces FeedStays's share.
- FeedStays will not sell a stay that cannot pay your level's share. You earn 5%, 6% or 7% of the booking price, by level.
5. Earnings lifecycle
- Pending — as soon as a booking is made through your store.
- Stayed — the day after guest checkout.
- Payable — on the 1st of the following month.
- Paid — via PayPal, Wise, Zelle or US bank transfer (ACH), once payable and above the minimum payout threshold.
Minimum payout is $25. Balances below this roll over to the next payout cycle.
Cancelled bookings earn no commission. If a booking is cancelled, refunded, or charged back after you've already been paid for it, the amount will be deducted (clawed back) from your future earnings.
Payouts are held until you have a valid tax form on file — a Form W-9 if you are a US person, or a Form W-8BEN if you are not (see Section 6).
6. Taxes
- If you are a US person and your total payments in a calendar year meet the applicable federal reporting threshold — we believe this is $2,000 for 2026; [COUNSEL: confirm] — FeedStays will issue you a Form 1099-NEC.
- Non-US creators must submit a valid Form W-8BEN before payouts begin. [COUNSEL: confirm withholding treatment and any tax-treaty handling for non-US creators.]
- You are solely responsible for reporting and paying any taxes owed on your earnings.
7. Your obligations as a creator
- Disclosure. You must clearly disclose your commercial relationship with FeedStays on every post and link promoting your store (for example, "#ad" or "I earn a commission on bookings"), consistent with the FTC's Endorsement Guides. [COUNSEL: confirm specific disclosure wording requirements.]
- Accuracy. No false claims about price, availability, or your relationship to the hotel — you are not the hotel and must not imply otherwise.
- No spam. No unsolicited bulk messaging to promote your store.
- No brand-term bidding. [COUNSEL: confirm — no paid search bidding on hotel brand names or "FeedStays" as keywords.]
- No self-dealing. [COUNSEL: confirm — bookings you make for your own stays through your own store are not eligible for commission.]
- Platform rules. You must comply with the rules of any platform (TikTok, Instagram, etc.) you use to promote your store.
- Audience data. If a guest opts in to join your community at checkout, we share their first name, last name, and email with you. You may use this only to contact them about travel-related content, must honor unsubscribe requests, must not resell or share this data with third parties, must delete it on request, and must comply with CAN-SPAM and TCPA (and any other applicable messaging law) in how you contact them.
- Community links. You may list up to four community links on your store (TikTok, Instagram, WhatsApp, Telegram, Discord, or a newsletter).
8. Content license
By posting a bio, notes, or video embeds (including TikTok video embeds) to your store, you grant FeedStays a license to display that content on FeedStays surfaces (your store page, widget, and related promotional placements) for as long as your store is active.
9. Creator referral bonus
You receive a $25 bonus when a creator you invite joins FeedStays. [COUNSEL: confirm conditions — our current understanding is that the bonus is granted when the invitee claims a store.]
10. Changes, suspension, and termination
- FeedStays may change commission rates or program terms with 30 days' notice. Rate changes are not retroactive — they do not affect bookings already made.
- FeedStays may suspend your store for suspected fraud or breach of this Agreement, and may terminate your participation with notice.
- If your participation ends, pending earnings for legitimate, completed stays will still be paid out on the normal schedule, unless the earnings are tied to fraud.
11. Disclaimers and liability
Your store is provided "as is." FeedStays does not guarantee any level of bookings, traffic, or earnings. [COUNSEL: confirm limitation-of-liability language consistent with the Terms of Use.]
12. Governing law and disputes
[COUNSEL: confirm governing law and arbitration/venue clause, consistent with the Terms of Use.]
